Terms of Service
These Terms take effect on 1 September 2026 and replace any earlier version.
1. Introduction, parties and acceptance
These Terms of Service ("Terms") are issued by Peekerton AB, a Swedish company with registration number 559224-2019 ("Peekerton", "we").
Peekerton provides an AI-driven competitive analysis service, available at peekerton.com or another URL designated by Peekerton ("Service"). The Service produces digital competitive analyses ("Analyses").
"Customer" or "you" means in these Terms the person or entity that registers an account, and every user added to an organization account under Section 4.3. By registering an account, you accept these Terms. No signature, order confirmation or separate agreement is required. If you register on behalf of a company or other entity, you confirm that you have authority to bind it, and "you" then means that entity.
The paid Service is offered to businesses and professionals only, not to consumers. Anyone may register a free view-only account. By subscribing or registering an organization account, you confirm that you are using Peekerton for business or professional purposes, not as a consumer.
2. These Terms and other agreements
Except as set out in Sections 2.2 and 2.3, these Terms are the entire agreement between you and Peekerton for the Service and supersede all prior terms and communications on the subject.
Larger volumes are handled under a separate written enterprise agreement with Peekerton. Where such an agreement covers a matter, it prevails over these Terms.
These Terms do not include a service level agreement or a data processing agreement. If Peekerton and you enter into either in writing, it forms part of the agreement between us and prevails within its subject matter.
3. The Service
Analyses are generated autonomously by Peekerton's proprietary software and AI technology, without human involvement. You set the scope and depth of each Analysis before it runs. Analyses are synthesized from public and private data sources and third-party online content.
Peekerton continuously improves the Service, so it changes over time. The Service is provided as is, and you have access to the version Peekerton makes available at any given time, with no right to any past or future version.
Peekerton will use reasonable efforts to keep the Service available, but does not guarantee any level of uptime.
Peekerton decides how the Service is produced and delivered, including the technologies, AI models and providers it uses, and may change them at any time.
4. Accounts
Anyone can register a free account. With a free account you can view Analyses that are shared with you and set the scope of an Analysis, but you need credits to order one.
Credits come with a subscription, as described in Section 5.
An organization account is a shared budget of credits for one organization, with administrators who manage its users and budget. By registering an organization account, the organization confirms it has authority to bind itself and gives the confirmation in Section 1.4 for itself and for its users. Each user is bound by these Terms when registering their own account, and the organization is responsible for its users' use of the Service. Analyses ordered using an organization account's credits are owned by the organization.
You are responsible for keeping your login credentials secure and for all activity under your account.
5. Credits, subscription and payment
A subscription gives you a number of credits per month. You pay in advance through the payment methods offered in the Service. Prices are stated exclusive of VAT unless otherwise indicated.
The subscription renews automatically each month until cancelled. You can cancel at any time. Cancellation takes effect at the end of the current subscription period.
Credits expire twelve months after they are issued. Remaining credits lapse when your subscription ends or your account is closed. Unused credits are not refunded, whether they expire or lapse.
Analyses are offered at different depth levels. You choose the depth for each Analysis, and the number of credits it costs depends on that choice.
Larger volumes are not available on a self-service basis and require an enterprise agreement under Section 2.2.
Prices may change. Peekerton will notify users at least 30 days before a price change takes effect. Section 14 applies to changes that materially worsen your position.
6. Ordering an Analysis
The agreement between you and Peekerton arises when you register your account.
Your subscription starts when you have chosen to subscribe and your first payment is approved.
An individual Analysis is ordered when you expressly approve its scope and depth in the Service and the required credits are deducted from your account. The Analysis then runs automatically. If you do not hold enough credits, no Analysis is ordered until you have them. No new agreement is formed for each Analysis.
If an Analysis cannot be completed for technical reasons, Peekerton returns the credits deducted for it. Peekerton's responsibility for an Analysis that does not complete is limited to returning those credits.
7. Ownership, sharing and archiving
The Customer that pays for an Analysis owns it.
Access to your Analyses requires an active subscription. If your subscription ends, your paid Analyses are archived and are no longer accessible, including to those you have shared them with. If you resubscribe, your archived Analyses become accessible again. If your account is closed, your Analyses are permanently deleted, not archived, and cannot be restored. Peekerton closes accounts only as set out in Sections 9 and 13.
You control who can access your Analyses through the Service's sharing features, including making an Analysis publicly available. Recipients access shared Analyses through the Service. Reselling Analyses, or redistributing them as a commercial product or service, is not permitted.
8. Intellectual property and feedback
Peekerton retains all intellectual property rights in the Service, its software, its methods, its trademarks, and the data underlying the Analyses. The underlying data consists of facts and information about companies and markets that are not unique to any Analysis, and Peekerton may use it to generate Analyses for other customers and for its own purposes.
You receive a non-exclusive, non-transferable licence to use your Analyses for your internal business purposes and to share them as described in Section 7.3. Ownership under Section 7.1 refers to this licence and to control over the Analysis within the Service; it does not transfer Peekerton's intellectual property.
If you give Peekerton feedback, suggestions or ideas about the Service, Peekerton may use them freely without restriction or compensation.
9. Acceptable use and enforcement
The part of the Service where you set the scope of an Analysis exists only for that purpose. It is not a general-purpose assistant and may decline other topics.
You may not misuse the Service, attempt to interfere with or circumvent its operation or its pricing, behave abusively, or use the Service for unlawful purposes.
The Service analyzes companies and industries, not private individuals. Names and roles of people acting for the companies you analyze may occur when setting the scope. Beyond that, you may not submit personal data as analysis input: no datasets containing personal data, no personal data about yourself, no personal data about individuals outside their role as representatives of a company, and no special categories of personal data (such as data concerning health or political opinions).
Peekerton monitors use of the Service to protect the Service and its customers.
If you breach these Terms, Peekerton may restrict, suspend or terminate your account. Where reasonable, Peekerton will notify you and give you an opportunity to respond.
10. Confidentiality
The content of an Analysis is not confidential in itself. What Peekerton treats as confidential is the connection between you and the companies or industries you analyze, together with the input you provide when setting the scope of an Analysis ("Confidential Information").
Confidential Information is handled strictly on a need-to-know basis within Peekerton, and only to provide the Service. Not even Peekerton's board of directors or shareholders can access it.
Each Analysis is a unique output, delivered only to the account that ordered it and never shared by Peekerton with any other customer or third party. You control sharing through Section 7.3. The underlying data, by contrast, is not unique to your Analysis and remains Peekerton's, and may be reused as described in Section 8.1.
These obligations do not apply to information that is or becomes publicly available through no breach by Peekerton, or that Peekerton must disclose under law, court order or stock exchange rules, in which case Peekerton will notify you where legally permitted and limit the disclosure to what is required.
11. Disclaimers and limitation of liability
Analyses are generated by AI. Peekerton makes no representation or warranty as to the accuracy, completeness or suitability of any Analysis for any purpose.
Peekerton does not provide financial, commercial, investment, tax, legal or accounting advice. Analyses are informational only. Consult relevant advisors before making decisions based on an Analysis. Decisions made on the basis of an Analysis are solely your responsibility.
Peekerton assumes no liability toward anyone other than the Customer that ordered the Analysis, including toward anyone the Analysis is shared with.
Peekerton is not liable for indirect, consequential or incidental damages, including lost profits or business opportunities.
Peekerton's total liability under these Terms is limited to the fees you have paid for the Service during the six months preceding the event giving rise to the claim.
To claim damages, you must notify Peekerton in writing within twelve months of when you discovered or should have discovered the damage, and in any event no later than twenty-four months after the event giving rise to the claim.
The limitations of liability in these Terms do not apply in cases of intent or gross negligence.
You acknowledge that these limitations are an essential part of these Terms and that the pricing of the Service reflects them.
12. Personal data
Peekerton processes personal data as an independent data controller, for its own purposes, in connection with providing the Service. This includes account data and any personal data appearing in Analyses.
Information about Peekerton's processing of personal data is available in Peekerton's Privacy Policy at peekerton.com/policies/privacy.
You are an independent data controller for your own use of any personal data appearing in Analyses and are responsible for having a lawful basis for that use.
13. Term and termination
These Terms apply from when you register your account until your account is closed, regardless of whether you have an active subscription or only free view-only access.
You may close your account at any time. Your subscription ends in accordance with Section 5.2, and Sections 5.3 and 7.2 apply to your credits and Analyses.
Either party may terminate the agreement with immediate effect if the other party (i) materially breaches these Terms and does not cure the breach within 30 days of written notice, (ii) becomes insolvent, or (iii) if continued performance becomes unlawful. If you terminate under this Section 13.3, Peekerton will refund the part of the fees you have paid that relates to the remaining subscription period.
Sections 8, 10, 11, 12, 15.3, 15.4 and 16 survive termination.
14. Changes to the Terms
Peekerton may update these Terms. Peekerton will notify you at least 30 days before an updated version takes effect.
If a change, including a price change, materially worsens your position, you may terminate the agreement with effect from the date the change takes effect, by notifying Peekerton before that date.
15. Miscellaneous
You may not assign the agreement without Peekerton's prior written consent. Peekerton may assign the agreement in connection with a merger, a reorganisation, or a sale of all or a substantial part of its business.
A party's failure to enforce a provision of these Terms is not a waiver of that provision or of any other right.
If a provision of these Terms is held invalid or unenforceable, it shall be applied to the greatest extent permitted, and the remaining provisions remain in full effect.
Peekerton gives notices under these Terms by email to the address registered to your account, or in the Service. A notice by email is deemed received on the day it is sent. You are responsible for keeping your registered email address current. Notices to Peekerton are given by email to legal@peekerton.com.
Peekerton may use your name and logo in its marketing to indicate that you are a customer, and only in that capacity. You may revoke this permission at any time with 30 days' written notice.
Neither party is liable for failure to perform caused by circumstances beyond its reasonable control, such as fire, flood, war, strikes, or decisions of public authorities, for as long as the circumstance persists, provided the affected party uses reasonable efforts to mitigate its effects.
16. Governing law and disputes
These Terms are governed by the substantive laws of Sweden.
Disputes arising out of or in connection with these Terms shall be settled by the Stockholm District Court as first instance.
